10.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOMUS CRYPTO S.R.L. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES.

10.3 Maximum Liability

Our total liability to you for any claims arising from or related to these Terms or the Services shall not exceed the greater of (a) €100 or (b) the amount you paid us in the 12 months preceding the claim.

10.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

13.1 By You

You may terminate your account at any time by contacting us or using the account settings.

We may suspend or terminate your access to the Services immediately, without prior notice, for any reason, including breach of these Terms.

13.3 Effect of Termination

Upon termination, your right to use the Services will immediately cease. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.

14.2 Jurisdiction

Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Brescia, Italy.

14.4 European Consumers

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Domus Crypto S.r.l. regarding the Services.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.
